1. Acceptance of Terms

By downloading, installing, or using the VocaStory mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and VocaStory. Please read them carefully before using our Service.

2. Age Requirements and Parental Consent

VocaStory is designed for use by families. The following age requirements apply:

  • Parents/Guardians: You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and manage the App.
  • Children: The App provides content for children aged 2-10. Children should use the App only under parental supervision. All child profiles must be created by a parent/guardian.
  • COPPA Compliance: In accordance with the Children's Online Privacy Protection Act, we require verifiable parental consent before collecting any data related to children under 13.

3. Account Registration

  • You must provide accurate and complete information when creating your account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account, including content created by your child profiles.
  • You must notify us immediately of any unauthorized use of your account.

4. Subscription and Payment

4.1 Plans

VocaStory offers Free, Plus ($4.99/month), and Premium ($7.99/month) subscription tiers. Features and limitations of each tier are described on our pricing page and within the App.

4.2 Billing

  • Subscriptions are billed through the Apple App Store or Google Play Store according to their respective billing policies.
  • Plus subscriptions include a 7-day free trial. You will not be charged during the trial period.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage and cancel your subscription through your App Store or Google Play account settings.

4.3 Refunds

Refund policies are governed by the Apple App Store and Google Play Store terms. We do not process refunds directly. Please contact Apple or Google for refund requests.

5. Voice Cloning Feature

  • By using the voice cloning feature, you consent to the recording, processing, and storage of your voice data for the purpose of creating a voice model.
  • You may only clone voices for which you have explicit permission. Cloning another person's voice without their consent is strictly prohibited.
  • Voice models are for personal, family use within the App only. You may not extract, export, or use voice models outside of VocaStory.
  • You can delete your voice data and voice models at any time through the App.

6. Content and Intellectual Property

6.1 Our Content

The App, including its design, features, classic story library, illustrations, and voice models, is owned by VocaStory and protected by intellectual property laws. Classic stories in our library are sourced from public domain works with original adaptations and illustrations.

6.2 AI-Generated Content

Stories generated by AI using your account are created for your personal, non-commercial family use. While you may enjoy these stories within the App, the underlying AI models, generation technology, and voice synthesis capabilities remain our intellectual property.

6.3 User Content

If you create or share scripts through the App's community features, you retain ownership of your original content but grant VocaStory a non-exclusive license to display and distribute it within the App.

7. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms.
  • Attempt to clone voices without the voice owner's explicit consent.
  • Use AI-generated content for commercial purposes without written permission.
  • Attempt to reverse engineer, decompile, or disassemble the App or its AI models.
  • Interfere with or disrupt the App's infrastructure or other users' experience.
  • Create content that is harmful, offensive, or inappropriate for children.
  • Share your account credentials with third parties.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. AI- generated stories are created algorithmically and may occasionally contain unexpected content. We recommend parental review of AI-generated stories.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOCASTORY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

  • You may terminate your account at any time by deleting your account through the App or by contacting support@vocatales.com.
  • We may suspend or terminate your account if you violate these Terms, with or without notice.
  • Upon termination, your right to use the App ceases immediately. Data deletion follows our Privacy Policy.

11. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

  1. Negotiation: We encourage you to contact us first at support@vocatales.com to resolve any concerns informally.
  2. Arbitration: If informal resolution fails, disputes will be settled by binding arbitration in accordance with applicable laws.

These Terms are governed by the laws of the jurisdiction in which VocaStory operates, without regard to conflict of law principles.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
